The record provided to GBIF clearly gives a CC BY license for the image, as seen here: http://www.gbif.org/occurrence/1272078426/verbatim which is from the relevant line in the Darwin Core Archive:

Either this photo's license has been changed since 14 October, or there's a problem with iNaturalist's export.
